{"id":3813,"date":"2022-08-16T08:01:22","date_gmt":"2022-08-16T08:01:22","guid":{"rendered":"https:\/\/filter.watch\/en\/?p=3813"},"modified":"2025-06-03T08:40:56","modified_gmt":"2025-06-03T08:40:56","slug":"policy-monitor-june-2022","status":"publish","type":"post","link":"https:\/\/filter.watch\/english\/2022\/08\/16\/policy-monitor-june-2022\/","title":{"rendered":"Policy Monitor \u2013 June 2022"},"content":{"rendered":"<h1>Summary<\/h1>\n<p>June was a busy month for internet policy making in Iran, especially as it concerns social and political rights of users. This month, the government announced plans to rapidly implement what is referred to in Iran as the Children<i>\u2019s Internet<\/i>, a program aimed at restricting access to the internet for children and teenagers.\u00a0 In addition, Khamenei pressured the judiciary to further regulate the internet to fight so-called fake news, while\u00a0 ICT Minister Eisa Zarepour reinforced his support for \u2018layered filtering\u2019. For the second year in a row, the government imposed a limited internet shutdown during university entrance exams.<\/p>\n<p>These developments should not be interpreted as isolated events, all of them align with the Islamic Republic\u2019s underlying philosophy around the internet and policy basis for the National Information Network(NIN). Meaning, the Iranian government views access to the internet as a service on NIN rather than a <a href=\"https:\/\/www.theverge.com\/2016\/7\/4\/12092740\/un-resolution-condemns-disrupting-internet-access\">right to internet access<\/a>.<\/p>\n<p>The government's ideal is to wield control over an Internet service that they can connect and disconnect at will for a specific segment of the population at any time.\u00a0 Moreover,\u00a0 a user is someone who is identifiable (i.e., lacking full privacy or anonymity) and has access to the content approved by the government\/ If the user acts in a manner not approved, the government can identify and persecute them.<\/p>\n<p>The Raeesi administration and Minister of ICT have worked from these perspectives. However, these\u00a0 policies pre-date his administration and will likely continue to be implemented regardless of who is president.<\/p>\n<h1><img decoding=\"async\" class=\"aligncenter size-full wp-image-3737\" src=\"https:\/\/filter.watch\/en\/wp-content\/uploads\/sites\/2\/2022\/06\/policy.png\" alt=\"\" width=\"1500\" height=\"122\" srcset=\"https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2022\/06\/policy.png 1500w, https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2022\/06\/policy-300x24.png 300w, https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2022\/06\/policy-1024x83.png 1024w, https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2022\/06\/policy-768x62.png 768w\" sizes=\"(max-width: 1500px) 100vw, 1500px\" \/><\/h1>\n<h2>Review of Iran\u2019s ten-year strategic document on Cyberspace<\/h2>\n<p>On June 14, President Raisi chaired the SCC\u2019s 82nd meeting. The goal of this meeting was to review the third section or chapter of the \u201c<a href=\"https:\/\/dotic.ir\/news\/9814\">strategic document of the Islamic Republic of Iran in cyberspace at the horizon of 2031<\/a>,\u201d according to Mehr News Agency.<\/p>\n<p>Last year in July 2021, the SCC published the strategic <a href=\"https:\/\/media.dotic.ir\/uploads\/org\/2021\/07\/19\/162667900158930400.pdf\">document<\/a>\u2019s first two sections. The third section explores macro goals such as the development of the digital economy, the design and establishment of the system of science, technology, and innovation in Cyberspace, and cyber-diplomacy.<\/p>\n<h2>Petitions against the SCC at the Administrative Court of Justice<\/h2>\n<p>On June 19, Parliament amended <a href=\"https:\/\/www.mehrnews.com\/amp\/5517970\/\">legislation<\/a> making it impossible to file complaints against the SCC\u2019s resolutions with the <a href=\"https:\/\/divan-edalat.ir\">Administrative Court of\u00a0 Justice<\/a> (ACJ).<\/p>\n<p>According to the amendment made to Article 12 of this law, a note has been added to it that prohibits handling of complaints regarding the approvals of the Supreme Council of Cyberspace by the ACJ.<\/p>\n<h2>Launching the \u201cChildren\u2019s Internet\u201d in Iran<\/h2>\n<p>On June 22, Zarepour promised that the \u201cInternet for Children and Teenagers\u201d would be launched and made available to Iranian families in two weeks.<\/p>\n<p>Zarepour said this plan was designed to \u201cprovide special Internet services for children\u201d and\u00a0 make cyberspace \u201csafe.\u201d He emphasized that the SCC has entrusted his ministry with this project.<\/p>\n<h2>Supreme Leader highlights urgency of regulating the internet<\/h2>\n<p>On June 28, Supreme Leader Ayatollah Ali Khamenei met with judiciary officials to highlight the urgency of further regulating the internet. He criticized what he views as an uncontrolled\u00a0 cyberspace. \u201cIf you do not have laws on this matter, make them quickly,\u201d he said.<\/p>\n<p>He added: \u201cEvery once in a while; a rumor spreads in cyberspace which worries people and destroys people\u2019s psychological security. One of the duties of the judiciary is to deal with these kinds of issues. First only newspapers would publish such things, but now it happens in cyberspace too.\u201d<\/p>\n<p>His recent statement is related to a resolution passed by SCC in February 2021, named \u201c<a href=\"https:\/\/rc.majlis.ir\/fa\/law\/show\/1643352\">Requirements On Preventing And Combating the Publication of False Information, News And News Content In Cyberspace<\/a>\u201d. This resolution set out to systematically prevent the publication of \u201cfake news and content in cyberspace.\u201d\u00a0 This resolution basically gave the Judiciary and the Ministry of Culture and Islamic Guidance the authority to take judicial action against individuals and organizations publishing what they believe is fake news.<\/p>\n<p>The main goal of such measures is to censor and control news and the media. For example, if a\u00a0 news agency does not meet the government's requirements, they would be labeled as\u00a0 fake news, and accordingly dissolved.<\/p>\n<h2>Internet shutdown during University Entrance Exams<\/h2>\n<p>On June 30, the Ministry of ICT spokesperson Mehdi Salem <a href=\"https:\/\/twitter.com\/DrMahdiSalem\/status\/1542384550369808386?s=20&amp;t=MRx1n7W941sBWTVK6BV1kg\">announced<\/a> on his Twitter account: \u201cAt the request of the Ministry of Science and the approval of the relevant authorities, access to the Internet will be limited in the areas where the entrance exams are held today and tomorrow.\u201d<\/p>\n<p>The main\u00a0 reason provided by the government for imposing an internet shutdown during the university exam was to stop cheating. Although there are other ways such as jamming to stop the type of cheating at issue, internet shutdown was the first and easiest solution. The policy also lacked transparency as officials have declared the relevant orders confidential.<\/p>\n<p>To investigate this claim a Twitter user <a href=\"https:\/\/twitter.com\/AmirMojiry\/status\/1549325306074435585?s=20&amp;t=Occl6mVmvpvU6AHPEsDiAg\">submitted<\/a> a freedom of information request on the Iranian government\u2019s Information Transparency Platform of the Iranian government, asking the Ministry of Science, Research and Technology to publish the internet shutdown request made to the Ministry of ICT or any other relative bodies.<\/p>\n<p>\"The requested documents and information are confidential documents and this institute[body] is not allowed to provide to an unauthorized person.\" said the ministry of ICT in response to a request by a citizen on the Information transparency platform of Iranian government.<\/p>\n<figure id=\"attachment_1296\" aria-describedby=\"caption-attachment_1296\" style=\"width: Ministry of Science also responded to this request: \u201cThe letter has a classified category, and it is not allowed to be published on the site.\u201d<\/p>\n<figure id=\"attachment_1297\" 28, Zarepour declared the news published regarding their blocking of WhatsApp and Instagram \u201cfake news.\u201d \u201cThis is just a rumor. Blocking is not within the Ministry of ICT\u2019s jurisdiction, and no decision has been made on this matter by any official institution,\u201d he <a href=\"https:\/\/newspaper.hamshahrionline.ir\/id\/102741\/%D8%AF%DA%A9%D9%85%D9%87%E2%80%8C%D9%87%D8%A7%DB%8C-%D9%81%DB%8C%D9%84%D8%AA%D8%B1%DB%8C%D9%86%DA%AF-%D8%B2%DB%8C%D8%B1-%D8%AF%D8%B3%D8%AA-%DB%8C%DA%A9%E2%80%8C%D9%86%D9%81%D8%B1-%D9%86%DB%8C%D8%B3%D8%AA%D9%86%D8%AF.html\">said<\/a>.<\/p>\n<p>In addition to Zarepour, former ICT Minister Mohammad Javad Azari Jahromi, also <a href=\"https:\/\/newspaper.hamshahrionline.ir\/id\/102741\/%D8%AF%DA%A9%D9%85%D9%87%E2%80%8C%D9%87%D8%A7%DB%8C-%D9%81%DB%8C%D9%84%D8%AA%D8%B1%DB%8C%D9%86%DA%AF-%D8%B2%DB%8C%D8%B1-%D8%AF%D8%B3%D8%AA-%DB%8C%DA%A9%E2%80%8C%D9%86%D9%81%D8%B1-%D9%86%DB%8C%D8%B3%D8%AA%D9%86%D8%AF.html\">claimed<\/a> in the past that as an executive arm he had no authority to block anything.<\/p>\n<p>According to Iranian laws, there are two <a href=\"https:\/\/newspaper.hamshahrionline.ir\/id\/40599\/%D9%85%D8%A7%D9%84%DA%A9%D8%A7%D9%86-%D8%AF%DA%A9%D9%85%D9%87-%D9%81%DB%8C%D9%84%D8%AA%D8%B1%DB%8C%D9%86%DA%AF.html\">ways<\/a> to filter a site or platform: 1) through a court order (this is similar to the Telegram blocking case, which was done with a court order by an investigator); and 2) through the official Working Group to Determine Examples of Criminal Content.<\/p>\n<h2>The Minister of ICT defends the Raisi government's \u201cLayered Filtering\u201d<\/h2>\n<p>On June 27, Zarepour defended enforcing \u2018layered filtering\u2019 during an <a href=\"https:\/\/www.irna.ir\/news\/84804496\/%D8%A7%D9%81%D8%B2%D8%A7%DB%8C%D8%B4-%DB%B7%DB%B0-%D8%AF%D8%B1%D8%B5%D8%AF%DB%8C-%D8%B8%D8%B1%D9%81%DB%8C%D8%AA-%D8%A7%DB%8C%D9%86%D8%AA%D8%B1%D9%86%D8%AA-%DA%A9%D8%B4%D9%88%D8%B1-%D8%AA%D8%A7-%D9%85%D9%87%D8%B1%D9%85%D8%A7%D9%87\">interview<\/a> on the Jahanara program broadcasted on Ofogh-TV. In recent years, the government has been shifting its practices away from direct and uniform methods of filtering and toward a system that tailors filtering methods for different target populations.<\/p>\n<p>He said, \u201cDuring the election, the President pointed out that there is no place in the world where the Internet available to a university professor is also available to a child. Clearly, these two groups have different needs. Providing children\u2019s Internet is a way to specialize it, and we started with children's internet first. This [layered filtering] has nothing to do with the labels given to the Cyberspace protection bill and claims related to the Internet shutdown during the last few months. No one in the Islamic Republic of Iran is aiming for an Internet shutdown.\u201d<\/p>\n<p>Contrary to his claims, this \u2018layered filtering\u2019 plan violates the principle of net neutrality, which requires service providers to provide equal internet access to all users. This means that all sites, content and applications should be accessible at the same speed and under the same conditions without blocking or giving preference to any content.<\/p>\n<p>The ICT Minister\u2019s comments are consistent with the Iranian government\u2019s policies to-date, not only in the specific context of layered filtering but also more broadly in terms of the advancement of the NIN and also the implementation of higher costs for users to access the international internet over the domestic one.<\/p>\n<h2>Offering Tapsi shares in OTC<\/h2>\n<p>On June 14, the stock market offered the initial shares of the Internet taxi company named \u201cTapsi\u201d (with the legal name Yashgaman Fanavari and Danesh Aramis).<\/p>\n<h2><img decoding=\"async\" class=\"alignnone size-full\" src=\"https:\/\/filter.watch\/en\/wp-content\/uploads\/sites\/2\/2022\/06\/cyber-1024x83.png\" width=\"1024\" height=\"83\" \/>Three managers of Telegram channels were arrested<\/h2>\n<p>On June 22 the IRGC's <a href=\"https:\/\/www.yjc.news\/fa\/news\/8163844\/%D8%A7%D8%AF%D9%85%DB%8C%D9%86-%D8%B3%D9%87-%DA%A9%D8%A7%D9%86%D8%A7%D9%84-%D8%AA%D9%84%DA%AF%D8%B1%D8%A7%D9%85%DB%8C-%D8%AA%D9%88%D8%B3%D8%B7-%D8%B3%D8%A7%D8%B2%D9%85%D8%A7%D9%86-%D8%A7%D8%B7%D9%84%D8%A7%D8%B9%D8%A7%D8%AA-%D8%B3%D9%BE%D8%A7%D9%87-%D8%A8%D8%A7%D8%B2%D8%AF%D8%A7%D8%B4%D8%AA-%D8%B4%D8%AF%D9%86%D8%AF\">public<\/a> relations department reported the arrest of the administrators of three Telegram channels on charges of publishing classified documents and disturbing public opinion.<\/p>\n<p>Arrest and harassment of civil activists and social media users for security and non-security reasons has been a trend for the past few years now.<\/p>\n<h2>Cyberattack on Iran\u2019s steel industry<\/h2>\n<p>On June 25 the SCC <a href=\"https:\/\/www.irna.ir\/news\/84803700\/%D8%A7%D8%B7%D9%84%D8%A7%D8%B9%DB%8C%D9%87-%D9%85%D8%B1%DA%A9%D8%B2-%D9%85%D9%84%DB%8C-%D9%81%D8%B6%D8%A7%DB%8C-%D9%85%D8%AC%D8%A7%D8%B2%DB%8C-%D8%AF%D8%B1%D8%AE%D8%B5%D9%88%D8%B5-%D8%AD%D9%85%D9%84%D9%87-%D8%B3%D8%A7%DB%8C%D8%A8%D8%B1%DB%8C-%D8%A8%D9%87-%D8%B3%DB%8C%D8%B3%D8%AA%D9%85-%D9%87%D8%A7%DB%8C-%D9%81%D9%88%D9%84%D8%A7%D8%AF\">announced<\/a> that Foulad\u2019s information technology systems experienced cyberattacks. According to the notice published by SCC,\u00a0 parts of Hormozgan and Khuzestan steel units were disrupted by cyberattacks at 6:30am local time.<\/p>\n<p>A hacker group called Predatory Sparrow [also known by its Persian name, Gonjeshke Darande] took responsibility for this cyberattack by publishing a video.
