{"id":3632,"date":"2022-06-03T15:20:26","date_gmt":"2022-06-03T15:20:26","guid":{"rendered":"https:\/\/filter.watch\/en\/?p=3632"},"modified":"2025-05-11T08:05:49","modified_gmt":"2025-05-11T08:05:49","slug":"fatawatch-january-march-2022","status":"publish","type":"post","link":"https:\/\/filter.watch\/english\/2022\/06\/03\/fatawatch-january-march-2022\/","title":{"rendered":"FATAwatch: January &#8211; March 2022"},"content":{"rendered":"<h2><b>What is FATA Watch?<\/b><\/h2>\n<p><span style=\"font-weight: 400\">In the past decade the security establishment and the judiciary in Iran have been one of the primary instruments of suppression and censorship on the internet.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The FATA cyber police force has been in the news for putting pressure on civil rights activists, journalists and well-known figures, but most of its sinister online activities have gone unreported.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In recent years, Filterwatch has paid special attention to the macro policies and key components of Iran\u2019s internet structure. We have <\/span><a href=\"https:\/\/filter.watch\/en\/2022\/04\/01\/disruption-of-irans-private-tech-sector\/\"><span style=\"font-weight: 400\">published<\/span><\/a><span style=\"font-weight: 400\"> analytical reports to shed light on the actions taken by FATA, the judiciary and the security agencies, documenting their impact on freedom of information and privacy.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In a series of quarterly reports entitled \u201cFATA Watch,\u201d we\u00a0<\/span><span style=\"font-weight: 400\">collect statements issued by FATA, as well as reports from news outlets and civil society sources, to document FATA\u2019s violations of human rights, in particular as they pertain to freedom on the Internet.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The reports illuminate how the FATA cyber police force carries out widespread arrests with backing from the judiciary and the security agencies. Despite insufficient details on these cases, we aim to gather and archive key facts pointing to the erosion of digital rights and expansion of censorship in Iran.<\/span><\/p>\n<h2><b>FATA\u2019s limitless authority<\/b><\/h2>\n<p><span style=\"font-weight: 400\">The first quarter of 2022 was once again marked by actions carried out by FATA and other security agencies to control and suppress legitimate, peaceful online activities. However, the scope of these measures went well beyond the usual crackdown on political activities and took a sharp turn toward suppressing lifestyle choices, even family planning. Most notable incidents include the extension of digital surveillance to satirical pages on social media and enforcement of a ban on sale of contraceptives online, in accordance with Article 59 of the <\/span><a href=\"https:\/\/cdn.yjc.news\/files\/fa\/news\/1400\/8\/21\/15105347_970.pdf\"><span style=\"font-weight: 400\">Youthful Population Law<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">FATA\u2019s priorities appear to be misaligned with the realities of and imminent threats to society. Despite <\/span><a href=\"https:\/\/www.isna.ir\/news\/1400121007793\/%25D8%25A8%25DB%258C%25D8%25B4%25D8%25AA%25D8%25B1%25DB%258C%25D9%2586-%25D8%25AC%25D8%25B1%25D8%25A7%25D8%25A6%25D9%2585-%25D8%25B3%25D8%25A7%25DB%258C%25D8%25A8%25D8%25B1%25DB%258C-%25D8%25AF%25D8%25B1-%25D8%25AA%25D9%2587%25D8%25B1%25D8%25A7%25D9%2586-%25DA%2586%25DB%258C%25D8%25B3%25D8%25AA\"><span style=\"font-weight: 400\">significant growth<\/span><\/a><span style=\"font-weight: 400\"> in financial cyber crimes, such as identity theft, fraud, phishing, and crypto currency scams in Iran, 20 percent of FATA\u2019s resources are still directed toward investigating so-called \u201c<\/span><a href=\"https:\/\/www.isna.ir\/news\/1400122922553\/%25DB%25B2%25DB%25B3%25DB%25B1-%25D9%2585%25DB%258C%25D9%2584%25DB%258C%25D8%25A7%25D8%25B1%25D8%25AF-%25D8%25A8%25D9%2587-%25D8%25AD%25D8%25B3%25D8%25A7%25D8%25A8-%25D9%2585%25D8%25A7%25D9%2584%25D8%25A8%25D8%25A7%25D8%25AE%25D8%25AA%25DA%25AF%25D8%25A7%25D9%2586-%25D8%25A8%25D8%25B1%25DA%25AF%25D8%25B1%25D8%25AF%25D8%25A7%25D9%2586%25D8%25AF%25DB%258C%25D9%2585\"><span style=\"font-weight: 400\">morality<\/span><\/a><span style=\"font-weight: 400\"> crimes,\u201d \u2013\u00a0a vague concept that underpins many cases of prosecution of online activities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Morality crimes are authorized in the Islamic Penal Code and the Computer Crimes Law. Article 641 of the <\/span><a href=\"http:\/\/www.davoudabadi.ir\/page\/8605732\/%25D9%2585%25D8%25A7%25D8%25AF%25D9%2587-641-%25D9%2582%25D8%25A7%25D9%2586%25D9%2588%25D9%2586-%25D9%2585%25D8%25AC%25D8%25A7%25D8%25B2%25D8%25A7%25D8%25AA-%25D8%25A7%25D8%25B3%25D9%2584%25D8%25A7%25D9%2585%25DB%258C\"><span style=\"font-weight: 400\">Islamic Penal Code<\/span><\/a><span style=\"font-weight: 400\"> prohibits insults, slander, threats, and humiliation, as well as digital messages containing \u201cinappropriate\u201d images. Article 14 of the <\/span><a href=\"https:\/\/rc.majlis.ir\/fa\/law\/show\/135717\"><span style=\"font-weight: 400\">Computer Crimes Law<\/span><\/a><span style=\"font-weight: 400\"> proscribes any use of computers and communication devices for producing, exchanging, or storing\u00a0 \u201cindecent content,\u201d in particular for the purpose of revenue generation.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The vague and broad wording of these laws has left ample room for selective interpretations of morality crimes and arbitrary measures by FATA. As this report indicates,FATA made a number of arrests for publishing immoral and indecent content on social media, citing <\/span><a href=\"https:\/\/rc.majlis.ir\/fa\/law\/show\/135717\"><span style=\"font-weight: 400\">note 5 to Article 14<\/span><\/a><span style=\"font-weight: 400\"> of the Computer Crimes Law which defines indecent content as \u201cany image, audio or text that reveals full male or female nudity and describes sexual acts.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, such content will first and foremost be a violation of the terms of use of social media networks and are often deleted before Iranian censors could even catch them. Our research suggests that FATA is, in effect, cracking down not on nudity but on small businesses that promote what is perceived by Iranian authorities as Western lifestyle. Photographers and fashion designers are often prime targets of this type of suppression.\u00a0<\/span><\/p>\n<h2><b>Cases in the first quarter of 2022\u00a0<\/b><\/h2>\n<p><b>January 3:<\/b><span style=\"font-weight: 400\"> The FATA police chief in Ardabil province <\/span><a href=\"https:\/\/cyberpolice.ir\/node\/158913\"><span style=\"font-weight: 400\">said<\/span><\/a><span style=\"font-weight: 400\"> the admin of an Instagram account belonging to a fashion business had been arrested for \u201cpromoting modeling by publishing immoral and indecent photos.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Also on this day, two people were arrested in Khorasan Razavi province and accused of disturbing public order with their social media posts: \u201cThe new Omicron variant has reached the gates of Mashhad at a time when we still haven\u2019t gotten our second and third vaccine shots.\u201d Their identities have not been revealed.<\/span><\/p>\n<p><b>January 16:<\/b><span style=\"font-weight: 400\"> The Human Rights Activists News Agency (HRANA) <\/span><a href=\"https:\/\/bit.ly\/34NloDU\"><span style=\"font-weight: 400\">reported<\/span><\/a><span style=\"font-weight: 400\"> the arrest of Farideh Moradkhani, the niece of Supreme Leader Ali Khamenei. She heads a campaign to support political prisoners. No reason has been given for her arrest and no charges have been made public yet.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, some have speculated that her arrest might have been in connection with a video posted on October 14, 2021, showing her reading a poem on ClubHouse and Instagram to celebrate the birthday of Farah Diba, the former empress of the Pahlavi Dynasty, deposed by the 1979 Islamic Revolution.\u00a0<\/span><\/p>\n<p><b>January 17:<\/b><span style=\"font-weight: 400\"> According to the FATA police chief in Tehran province, several people were <\/span><a href=\"https:\/\/cyberpolice.ir\/index.php\/node\/159132\"><span style=\"font-weight: 400\">arrested<\/span><\/a><span style=\"font-weight: 400\"> for allegedly running an Instagram page containing so-called immoral images. No further information is available yet.<\/span><\/p>\n<p><b>January 23:<\/b><span style=\"font-weight: 400\"> A man was <\/span><a href=\"https:\/\/cyberpolice.ir\/node\/159225\"><span style=\"font-weight: 400\">arrested<\/span><\/a><span style=\"font-weight: 400\"> near Tehran for his video on Instagram insulting the people of northern Iran. He was forced to apologize on state television.\u00a0\u00a0<\/span><\/p>\n<p><b>January 25:<\/b><span style=\"font-weight: 400\"> Rap singer Toomaj Salehi was given a suspended prison sentence for his political rap songs, human rights groups <\/span><a href=\"https:\/\/www.bbc.com\/persian\/iran-60123931\"><span style=\"font-weight: 400\">reported<\/span><\/a><span style=\"font-weight: 400\">. According to <\/span><a href=\"https:\/\/www.hra-news.org\/2022\/hranews\/a-33439\/\"><span style=\"font-weight: 400\">HRANA<\/span><\/a><span style=\"font-weight: 400\">, the Revolutionary Court in Shahin Shahr fined and sentenced him to six months in prison. The sentence was suspended for one year. Salehi was arrested at his home in Isfahan in September 2021 and accused of \u201cinsulting the Supreme Leader\u201d and disseminating \u201cpropaganda against the state\u201d through publishing his protest songs on social media.<\/span><\/p>\n<p><b>January 26:<\/b><span style=\"font-weight: 400\"> Reza Nabavi Chashmi was transferred to the Central Prison in Semnan to serve a <\/span><a href=\"https:\/\/bit.ly\/3JnGPud\"><span style=\"font-weight: 400\">32-month prison term<\/span><\/a><span style=\"font-weight: 400\"> on charges of \u201conline activities and insulting state officials.\u201d\u00a0<\/span><\/p>\n<p><b>January 27<\/b><span style=\"font-weight: 400\">: Persian-language news site <\/span><i><span style=\"font-weight: 400\">Independent Farsi<\/span><\/i> <a href=\"https:\/\/bit.ly\/3gBTD3B\"><span style=\"font-weight: 400\">reported<\/span><\/a><span style=\"font-weight: 400\"> that the police in Iran had arrested 17 people for posting humorous candid camera clips that \u201cpromoted unusual cultural values.\u201d The accounts of social media influencers involved were blocked and they were accused of sensationalism to drive up followers on Instagram. One of them was forced to make a \u201cconfession\u201d on state television and apologize for not applying for an official permit.\u00a0<\/span><\/p>\n<p><b>January 31:<\/b><span style=\"font-weight: 400\"> The police chief in Bafgh, in Yazd province, said one person had been <\/span><a href=\"https:\/\/bit.ly\/3LBO1oz\"><span style=\"font-weight: 400\">arrested<\/span><\/a><span style=\"font-weight: 400\"> and charged with \u201cpublishing immoral and unconventional movies\u201d on Telegram.\u00a0<\/span><\/p>\n<p><b>February 3:<\/b><span style=\"font-weight: 400\"> Security forces <\/span><a href=\"https:\/\/www.bbc.com\/persian\/iran-60181093\"><span style=\"font-weight: 400\">prevented<\/span><\/a><span style=\"font-weight: 400\"> an event on Clubhouse to mark 4,000 days since the extra-judicial house arrest of the Green Movement opposition leaders, Mirhossein Mousavi, Zahra Rahnavard, and Mehdi Karroubi. Security officials have threatened to press charges against the event organizers in Iran.<\/span><\/p>\n<p><b>February 27:<\/b><span style=\"font-weight: 400\"> The Islamic Revolutionary Guards Corps (IRGC) in Khuzestan province announced the arrest of a man for \u201cleading cyber activities and spreading corruption.\u201d The man, identified only as \u201cM.V.A.\u201d, was arrested along with a number of his accomplices. While the announcement did not give any details about their activities, the term \u201cspreading corruption\u201d typically refers to promoting Western values and culture.<\/span><\/p>\n<p><b>March 2:<\/b><span style=\"font-weight: 400\"> Two teenage girls, with about 300 followers on Instagram, were <\/span><a href=\"https:\/\/www.irna.ir\/news\/84668508\/%25DA%25AF%25D8%25B1%25D8%25AF%25D8%25A7%25D9%2586%25D9%2586%25D8%25AF%25DA%25AF%25D8%25A7%25D9%2586-%25D8%25B5%25D9%2581%25D8%25AD%25D8%25A7%25D8%25AA-%25D8%25BA%25DB%258C%25D8%25B1%25D8%25A7%25D8%25AE%25D9%2584%25D8%25A7%25D9%2582%25DB%258C-%25D8%25A7%25DB%258C%25D9%2586%25D8%25B3%25D8%25AA%25D8%25A7%25DA%25AF%25D8%25B1%25D8%25A7%25D9%2585-%25D8%25AF%25D8%25B1-%25D8%25A2%25D8%25A8%25D8%25A7%25D8%25AF%25D8%25A7%25D9%2586-%25D8%25AF%25D8%25B3%25D8%25AA%25DA%25AF%25DB%258C%25D8%25B1-%25D8%25B4%25D8%25AF%25D9%2586%25D8%25AF\"><span style=\"font-weight: 400\">arrested<\/span><\/a><span style=\"font-weight: 400\"> in Abadan, Khuzestan province, for what was described as \u201cpublishing immoral content on the Internet.\u201d\u00a0<\/span><\/p>\n<p><b>March 6:<\/b><span style=\"font-weight: 400\"> Two young men, 19 and 21-years old, were <\/span><a href=\"https:\/\/cyberpolice.ir\/node\/160142\"><span style=\"font-weight: 400\">arrested<\/span><\/a><span style=\"font-weight: 400\"> in Gilan province for running an Instagram account containing \u201cimmoral\u201d photos and videos.<\/span><\/p>\n<p><b>March 7:<\/b><span style=\"font-weight: 400\"> Yasmin Aziz Azan, an advocate for Arab ethnic minority rights, was <\/span><a href=\"https:\/\/www.kampain.info\/archive\/63505.htm\"><span style=\"font-weight: 400\">arrested<\/span><\/a><span style=\"font-weight: 400\"> after being summoned to the Intelligence Ministry office in the port city of Khorramshahr and transferred to the Khuzestan provincial capital, Ahvaz. Her Instagram account was shut down.<\/span><\/p>\n<p><b>March 9:<\/b><span style=\"font-weight: 400\"> Mohammad Alishvandi and Fathollah Gholami, two members of the Teachers Trade Association, were <\/span><a href=\"https:\/\/www.hra-news.org\/2022\/hranews\/a-34016\/\"><span style=\"font-weight: 400\">summoned<\/span><\/a><span style=\"font-weight: 400\"> to the Revolutionary Court in Farashband, Fars province, and charged with \u201cpropaganda against the state on the Internet.\u201d<\/span><\/p>\n<p><b>March 10:<\/b><span style=\"font-weight: 400\"> A photography studio owner was <\/span><a href=\"https:\/\/cyberpolice.ir\/node\/160222\"><span style=\"font-weight: 400\">arrested<\/span><\/a><span style=\"font-weight: 400\"> in Gilan province for posting \u201cindecent\u201d samples of his work on Instagram. The police forced him to delete all the content on his account with several thousand followers.<\/span><\/p>\n<p><b>March 11:<\/b><span style=\"font-weight: 400\"> The FATA police chief warned in an <\/span><a href=\"https:\/\/www.borna.news\/%25D8%25A8%25D8%25AE%25D8%25B4-%25D8%25A7%25D8%25AC%25D8%25AA%25D9%2585%25D8%25A7%25D8%25B9%25DB%258C-4\/1307496-%25D9%2581%25D8%25B1%25D9%2588%25D8%25B4-%25D8%25A7%25D9%2582%25D9%2584%25D8%25A7%25D9%2585-%25D9%25BE%25DB%258C%25D8%25B4%25DA%25AF%25DB%258C%25D8%25B1%25DB%258C-%25D8%25A7%25D8%25B2-%25D8%25A8%25D8%25A7%25D8%25B1%25D8%25AF%25D8%25A7%25D8%25B1%25DB%258C-%25D8%25AF%25D8%25B1-%25D9%2581%25D8%25B6%25D8%25A7%25DB%258C-%25D9%2585%25D8%25AC%25D8%25A7%25D8%25B2%25DB%258C-%25D8%25AC%25D8%25B1%25D9%2585-%25D8%25A7%25D8%25B3%25D8%25AA\"><span style=\"font-weight: 400\">interview<\/span><\/a><span style=\"font-weight: 400\"> that online sale of contraception pills and condoms was illegal and would be prosecuted as criminal activity. He said six people had been arrested in Alborz, Tehran and Kermanshah provinces for selling abortion pills online.\u00a0<\/span><\/p>\n<p><b>March 12: <\/b><span style=\"font-weight: 400\">The police chief in Kohgilouyeh and Boyer-Ahmad province said one person, identified as \u201cR.F.\u201d, had been <\/span><a href=\"https:\/\/www.farsnews.ir\/kohgiluyeh-boyerahmad\/news\/14001221000339\/%25D8%25AF%25D8%25B3%25D8%25AA%25DA%25AF%25DB%258C%25D8%25B1%25DB%258C-%25D8%25B9%25D8%25A7%25D9%2585%25D9%2584-%25D8%25AA%25D8%25B4%25D9%2588%25DB%258C%25D8%25B4-%25D8%25A7%25D8%25B0%25D9%2587%25D8%25A7%25D9%2586-%25D8%25B9%25D9%2585%25D9%2588%25D9%2585%25DB%258C-%25D8%25AF%25D8%25B1-%25D8%25A7%25DB%258C%25D9%2586%25D8%25B3%25D8%25AA%25D8%25A7%25DA%25AF%25D8%25B1%25D8%25A7%25D9%2585\"><span style=\"font-weight: 400\">arrested<\/span><\/a><span style=\"font-weight: 400\"> for \u201cdisturbing public opinion on social media by posting provocative images to instigate debates on honor and revenge.\u201d<\/span><\/p>\n<p><b>March 24: <\/b><span style=\"font-weight: 400\">Journalist and political activist Hossein Roueintan was <\/span><a href=\"https:\/\/www.hra-news.org\/2022\/hranews\/a-34194\/\"><span style=\"font-weight: 400\">sentenced<\/span><\/a><span style=\"font-weight: 400\"> to 20 years in prison by the Revolutionary Court in Dashtestan, Bushehr province. He was charged with disseminating \u201cpropaganda against the state\u201d and \u201cinsulting the sacred and the Supreme Leader\u201d in connection with launching online campaigns and calling for \u201cillegal\u201d rallies.<\/span><\/p>\n<p><b>March 26:<\/b><span style=\"font-weight: 400\"> In Divandareh, Kurdistan province, the admin of an Instagram account was <\/span><a href=\"https:\/\/cyberpolice.ir\/node\/160516\"><span style=\"font-weight: 400\">arrested<\/span><\/a><span style=\"font-weight: 400\"> for posting alleged \u201cobscenities and insults against the police.\u201d No details have been made public.<\/span><\/p>\n<h2><b>FATA: The violator of digital rights<\/b><\/h2>\n<p><span style=\"font-weight: 400\">In the first quarter of 2022, we documented more than 20 instances of violations of digital rights by Iran\u2019s police, judiciary and security forces. For decades, Iran has trampled on the basic principles of international human rights law, namely the right to freedom of expression, privacy, and assembly. The cases in this report confirm that human rights violations in Iran persist and impact legitimate online activities, making the Islamic Republic one of the worst <\/span><a href=\"https:\/\/www.statista.com\/statistics\/272533\/degree-of-internet-freedom-in-selected-countries\/\"><span style=\"font-weight: 400\">enemies of the Internet<\/span><\/a><span style=\"font-weight: 400\"> in the world.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In the coming months, we will continue to monitor and document suppression of online activities, with the hope that these reports will contribute to greater transparency and accountability for authorities, and a safer digital environment for Iranians, particularly vulnerable groups such as activists and journalists.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>What is FATA Watch?
