{"id":3369,"date":"2021-12-08T10:08:02","date_gmt":"2021-12-08T10:08:02","guid":{"rendered":"https:\/\/filter.watch\/en\/?p=3369"},"modified":"2025-06-03T08:40:58","modified_gmt":"2025-06-03T08:40:58","slug":"policy-monitor-november-2021","status":"publish","type":"post","link":"https:\/\/filter.watch\/english\/2021\/12\/08\/policy-monitor-november-2021\/","title":{"rendered":"Policy Monitor &#8211; November 2021"},"content":{"rendered":"<p><span style=\"font-weight: 400\">This November marks the second anniversary of the <\/span><a href=\"https:\/\/medium.com\/filterwatch\/iran-shutdown-monitor-ccd4cad2a681\"><span style=\"font-weight: 400\">nationwide 2019 fuel price protests<\/span><\/a><span style=\"font-weight: 400\">, which were met with a nationwide Internet shutdown that lasted for more than a week. The shutdown took place to provide cover for the killing of hundreds of protestors, and the arrest of thousands more. While Iranians have not endured a nationwide shutdown since November 2019, since then there has been a significant rise in the number of localised internet shutdowns, almost always used to disrupt protests and facilitate violent crackdowns against protestors.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Iranian government has refused accountability and acted with impunity about the events of the 2019 shutdown, as well as the <\/span><a href=\"https:\/\/filter.watch\/en\/2021\/09\/03\/internet-shutdown-trends-in-iran-from-november-2019-to-july-2021\/\"><span style=\"font-weight: 400\">subsequent localised shutdowns<\/span><\/a><span style=\"font-weight: 400\"> since. Since these events, the then-Chief Justice Ebrahim Raisi has <\/span><a href=\"https:\/\/filter.watch\/en\/2021\/10\/29\/passing-the-baton-raisi-continues-the-assault-on-irans-internet\/\"><span style=\"font-weight: 400\">risen<\/span><\/a><span style=\"font-weight: 400\"> to the position of Iran\u2019s President. While a number of civil society groups focused on remembering and seeking justice for the victims of November 2019 at the <\/span><a href=\"https:\/\/abantribunal.com\/about-us\/\"><span style=\"font-weight: 400\">Aban Tribunal<\/span><\/a><span style=\"font-weight: 400\">, Iran saw yet another localised, internet shutdown in November, this time in response to protests in Isfahan Province. This marks the sixth localised shutdown to be implemented by Iranian authorities since November 2019.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Also in November, further progress was made around the \u201cOnline Services Bill,\u201d this time following an intervention from Iran\u2019s ICT Minister. For a second month, we saw a cyberattack targeting Iranian services, which saw Mahan Air\u2019s website being taken down. Iran\u2019s Parliament also made moves to further crackdown on online betting and gambling, pursuing a proposed amendment to the Islamic Penal Code.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Our monthly Network Monitor supplements this report with the latest internet disruptions and outages in Iran.\u00a0<\/span><\/p>\n<p><img decoding=\"async\" class=\"alignnone wp-image-2301\" src=\"https:\/\/filter.watch\/en\/wp-content\/uploads\/sites\/2\/2020\/05\/policy-300x24.png\" alt=\"\" width=\"950\" height=\"76\" srcset=\"https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2020\/05\/policy-300x24.png 300w, https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2020\/05\/policy-1024x83.png 1024w, https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2020\/05\/policy-768x62.png 768w, https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2020\/05\/policy.png 1500w\" sizes=\"(max-width: 950px) 100vw, 950px\" \/><\/p>\n<h2><b>Localised Internet Shutdown in Isfahan Province Amid Violent Crackdown By Authorities Against Protestors \/\/ Localised Shutdown Also Observed in Khuzestan Province\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400\">Over the past few<\/span><a href=\"https:\/\/www.bbc.com\/persian\/iran-59281203\"><span style=\"font-weight: 400\"> weeks<\/span><\/a><span style=\"font-weight: 400\">, multiple protests have taken place in the central province of Isfahan. These protests \u2013 participated in by a significant number of farmers and agricultural workers \u2013 have been taking place on and around dried-out sections of the Zayanderud\u2019s riverbed. The demonstrations have been staged to voice anger and frustration around authorities\u2019 handling of chronic water shortages that have affected the province.<\/span><\/p>\n<p><span style=\"font-weight: 400\">On the evening of 25 November, the crackdown commenced, with<\/span> <a href=\"https:\/\/twitter.com\/bbcpersian\/status\/1463919177375354883\"><span style=\"font-weight: 400\">multiple<\/span><\/a> <a href=\"https:\/\/twitter.com\/RadioFarda_\/status\/1464230476219039754\"><span style=\"font-weight: 400\">reports<\/span><\/a><span style=\"font-weight: 400\"> of <\/span><span style=\"font-weight: 400\">security forces\u2019<\/span> <a href=\"https:\/\/twitter.com\/bbcpersian\/status\/1464231919944675336\"><span style=\"font-weight: 400\">use of rubber and pellet bullets<\/span><\/a> <span style=\"font-weight: 400\">and teargas against peaceful protesters, which continued into the next day. A number of injured protesters can be seen in video footage shared by individuals at the scene. Footage has also been shared of<\/span> <a href=\"https:\/\/twitter.com\/bbcpersian\/status\/1464647797223964673\"><span style=\"font-weight: 400\">property damage<\/span><\/a> <span style=\"font-weight: 400\">at the hands of the security forces.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">As clashes between protesters and security forces escalated, a mobile internet shutdown was <\/span><a href=\"https:\/\/twitter.com\/Ammir\/status\/1464251143551389697\"><span style=\"font-weight: 400\">confirmed<\/span><\/a><span style=\"font-weight: 400\"> in central areas of Isfahan by cybersecurity and digital rights researcher Amir Rashidi. According to Rashidi, domestic services via the National Information Network (NIN) were also unavailable, however, fixed broadband services were still connected. He added that internet connectivity appeared to vary depending on users\u2019 location within the city. People close to the center of Isfahan (near the site of the protests) reported<\/span> <a href=\"https:\/\/twitter.com\/Ammir\/status\/1464282873553375243\"><span style=\"font-weight: 400\">receiving<\/span><\/a> <span style=\"font-weight: 400\">text messages from the judiciary to leave the area immediately. According to figures from Iran\u2019s Communications Regulatory Authority (CRA), a majority of Isfahan\u2019s population rely on mobile internet services for their access: mobile internet penetration rates sit at 103.78%, compared to 17.45% for fixed line broadband connections.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Also on 25 November, Rashidi <\/span><a href=\"https:\/\/twitter.com\/Ammir\/status\/1463889110653878279\"><span style=\"font-weight: 400\">reported<\/span><\/a> <span style=\"font-weight: 400\">that mobile internet had been cut off in the city of Ahvaz, the provincial capital of Khuzestan Province. A number of domestic apps and websites remained accessible. Connectivity was restored the next day on<\/span> <a href=\"https:\/\/twitter.com\/Ammir\/status\/1464342980060459011\"><span style=\"font-weight: 400\">26 November<\/span><\/a> <span style=\"font-weight: 400\">but speeds remained slow. This marks the second internet shutdown in Khuzestan Province this year, with the first taking place i<\/span><span style=\"font-weight: 400\">n <\/span><a href=\"https:\/\/filter.watch\/en\/2021\/07\/19\/shutdown-monitor-local-internet-disruptions-target-escalating-water-protests-in-khuzestan\/\"><span style=\"font-weight: 400\">July 2021<\/span><\/a><span style=\"font-weight: 400\">, following water shortage protests.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">According to HRANA on 27 November, at least 214 people were<\/span> <a href=\"https:\/\/www.hra-news.org\/2021\/hranews\/a-32638\"><span style=\"font-weight: 400\">arrested<\/span><\/a> <span style=\"font-weight: 400\">during the protests in Isfahan, 13 of whom were children. Some of those arrested have been released following the seizure of their IDs and providing written affidavits and statements, while around 150 have been relocated to a variety of prisons and detention centers. According to a<\/span> <a href=\"https:\/\/www.bbc.com\/persian\/iran-59441879\"><span style=\"font-weight: 400\">report<\/span><\/a><span style=\"font-weight: 400\"> by the IRGC affiliated news outlet <\/span><i><span style=\"font-weight: 400\">Fars News<\/span><\/i><span style=\"font-weight: 400\">, Police Special Units Commander Hassan Karami announced that 67 people had been arrested during the protests.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Iran Human Rights<\/span> <a href=\"https:\/\/iranhr.net\/en\/articles\/4996\/\"><span style=\"font-weight: 400\">confirmed<\/span><\/a><span style=\"font-weight: 400\"> t<\/span><span style=\"font-weight: 400\">hat at least 30 protestors have been hospitalised with eye injuries and at least three protesters have been killed. These figures could rise further as more information becomes available<\/span><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><b>\u00a0<\/b><span style=\"font-weight: 400\">The<\/span> <a href=\"https:\/\/filter.watch\/en\/2021\/09\/03\/internet-shutdown-trends-in-iran-from-november-2019-to-july-2021\/\"><span style=\"font-weight: 400\">rising number of localised internet<\/span><\/a> <span style=\"font-weight: 400\">shutdowns demonstrate just how closely linked Internet shutdowns are to the acceleration and intensification of violent crackdowns on protests. Filterwatch strongly condemns the violent response of security forces in Isfahan, which has already seen multiple protestors killed or seriously injured.<\/span><\/p>\n<h2><b>\u201cOnline Services Bill\u201d Returns to the Parliamentary Research Centre for Review\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400\">On<\/span><a href=\"https:\/\/www.zoomit.ir\/tech-iran\/376965-ict-ministry-proposals-parliament-plan\/\"><span style=\"font-weight: 400\"> 29 November<\/span><\/a><span style=\"font-weight: 400\"> the Parliamentary Joint Special Committee responsible for reviewing the \u201cSupporting User\u2019s Rights Online and Core User Services Bill\u201d (also known as \u0637\u0631\u062d \u0635\u06cc\u0627\u0646\u062a in Persian, hereafter referred to as the \u201cOnline Services Bill\u201d) held its ninth meeting.<\/span><\/p>\n<p><span style=\"font-weight: 400\">During the session a number of MPs began referencing a letter sent\u00a0 from the ICT Minister, Eisa Zarepour, containing comments and recommendations as a new draft of the Bill sent to the Head of the Committee, Reza Taghipour. Following the MP\u2019s comments, Taghipour eventually confirmed the receipt of the letter and added that it was marked \u201cconfidential\u201d which is why he had not read it out.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">During the meeting three proposals were put forward:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The Bill should be referred to the Parliamentary Research Centre (PRC) to combine the government\u2019s recommendations (made via the ICT Ministry) with the Bill;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The Bill should be reviewed via four special committees in the presence of governmental PRC representatives;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The Bill\u2019s review process should continue as normal.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">At the tenth session held on <\/span><a href=\"https:\/\/twitter.com\/Peivast\/status\/1465670548013432839\"><span style=\"font-weight: 400\">30 November<\/span><\/a><span style=\"font-weight: 400\"> the Committee voted in favour of the Bill being passed to the PRC. The PRC is to review the Bill over the period of ten days in light of the ICT Ministry\u2019s proposals, and feedback from the private sector. The PRC\u2019s review is to begin next; however, these sessions continue to be headed by Taghipur.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Before the official start of the tenth session \u2013 which was recorded \u2013 Taghipour can be <\/span><a href=\"https:\/\/twitter.com\/kheyzaran\/status\/1465699793645146130\"><span style=\"font-weight: 400\">heard<\/span><\/a><span style=\"font-weight: 400\"> discussing the order of votes on the options available to the Committee with Lotfollah Siahkoli MP in order to gain votes to pass their favoured option of a review by the PRC.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Following the review, the Bill is set to return to the Committee for a vote on its latest version. The review follows widespread public backlash and criticism from the tech sector. The exact contents of Zarepour\u2019s draft Bill have not been publicly revealed, though some members of the Committee have commented that the ICT Ministry\u2019s draft of the Bill is \u201c30% different to the current version.\u201d\u00a0<\/span><\/p>\n<p><i><span style=\"font-weight: 400\">Filterwatch <\/span><\/i><span style=\"font-weight: 400\">will continue to provide updates on the progress of the Bill in future editions of the Policy Monitor.\u00a0<\/span><\/p>\n<h2><b>Parliament Moves Ahead with Bill for Sentencing Online Gambling\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400\">On <\/span><a href=\"https:\/\/www.imna.ir\/news\/534443\/%D9%85%D9%88%D8%A7%D9%81%D9%82%D8%AA-%D9%85%D8%AC%D9%84%D8%B3-%D8%A8%D8%A7-%DA%A9%D9%84%DB%8C%D8%A7%D8%AA-%D8%B7%D8%B1%D8%AD-%D9%85%D8%AC%D8%A7%D8%B2%D8%A7%D8%AA-%D9%82%D9%85%D8%A7%D8%B1%D8%A8%D8%A7%D8%B2%DB%8C-%D8%A7%DB%8C%D9%86%D8%AA%D8%B1%D9%86%D8%AA%DB%8C\"><span style=\"font-weight: 400\">10 November<\/span><\/a><span style=\"font-weight: 400\"> the Majles (Iran\u2019s parliament) approved the \u201cAmendments to the Articles of the Fifth Book of the Islamic Penal Code (705 - 711) Bill.\u201d The part of the Penal Code referred to in the Bill deals with sentencing for betting, gambling, and lotteries.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Bill seeks to codify sentencing for any form of participation or promotion of online betting, gambling, or lottery games into the Penal Code. This includes a grade seven sentence for promoting betting, gambling, or lottery games \u2013 amounting to 91 days\u2019 imprisonment and a 100 to 200 million IRR fine. It also mandates the confiscation of any income as a result of gambling, in addition to a fine for double the winnings\u2019 value.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Anyone participating in the running of online or offline gambling sites or casinos is subject to grade five sentencing, which includes a fine of 80 to 180 million IRR and deprivation from social services for five to 15 years. The Bill also includes sentencing provisions for those creating or selling tools enabling gambling, as well as for authorities failing to report instances of crimes set out under the Bill.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Bill has now been handed over to the Guardian Council for comments and approval before it can enter into law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Online betting and gambling has been a major concern for Iranian authorities who believe that the practices promote \u201ccorruption\u201d and are leading to \u201dwealth leaving the country.\u201d Iran\u2019s Cyber Police (FATA), has had a major focus in targeting gambling and betting sites and their administrators, which have been highlighted in <\/span><i><span style=\"font-weight: 400\">Filterwatch\u2019s <\/span><\/i><span style=\"font-weight: 400\">quarterly <\/span><a href=\"https:\/\/filter.watch\/en\/category\/fatawatch\/\"><span style=\"font-weight: 400\">FATAwatch<\/span><\/a><span style=\"font-weight: 400\"> reports. This Bill, which is likely to be approved by the Guardian Council, will make it much easier for Iranian authorities to target and sentence online betting and gambling.\u00a0<\/span><\/p>\n<h2><b>Iran\u2019s ICT Minister Responds to Slow Internet Speeds<\/b><\/h2>\n<p><span style=\"font-weight: 400\">On <\/span><a href=\"https:\/\/www.irna.ir\/news\/84547289\/%D8%B3%D8%B1%D8%B9%D8%AA-%D8%A7%DB%8C%D9%86%D8%AA%D8%B1%D9%86%D8%AA-%D8%A8%D8%A7%DB%8C%D8%AF-%D8%A8%D9%87-%DA%86%D9%86%D8%AF-%D8%B5%D8%AF-%D9%85%DA%AF%D8%A7%D8%A8%DB%8C%D8%AA-%D8%A8%D8%B1%D8%AB%D8%A7%D9%86%DB%8C%D9%87-%D8%A8%D8%B1%D8%B3%D8%AF\"><span style=\"font-weight: 400\">18 November<\/span><\/a><span style=\"font-weight: 400\"> Eisa Zarehpour commented on the ongoing issue of slow internet speeds at an event held for Iran\u2019s \u2018Book Week.\u2019\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">During the event he was asked about the issue of slow internet speeds. He responded by using a journalist\u2019s phones to perform a speed test, which showed speeds of 16 MB\/s. Zarepour added that while this speed was not acceptable, some of the issues were down to media hype, and some were caused following the start of the academic year and the reopening of schools and universities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">According to the government news agency <\/span><i><span style=\"font-weight: 400\">IRNA, <\/span><\/i><span style=\"font-weight: 400\">domestic and international capacity has increased by 10% to deal with the recent slow speeds.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In October, a number of Iranian outlets reported that a lack of international bandwidth available in the country is to blame for slow speeds. This, they claim, is the result of the SCC not issuing a license for the Telecommunication Infrastructure Company (TCI) to increase their purchase of global bandwidth to meet rising domestic demand \u2013 a position they have taken since Raisi\u2019s inauguration.<\/span><\/p>\n<h2><b>\u2018Sadegh Abbasi-Shahkuh\u2019 Appointed as the Head of the Communication Regulatory Authority<\/b><\/h2>\n<p><span style=\"font-weight: 400\">On <\/span><a href=\"https:\/\/www.mehrnews.com\/news\/5348632\/%D8%B5%D8%A7%D8%AF%D9%82-%D8%B9%D8%A8%D8%A7%D8%B3%DB%8C-%D8%B4%D8%A7%D9%87%DA%A9%D9%88%D9%87-%D8%B1%D8%A6%DB%8C%D8%B3-%D8%B3%D8%A7%D8%B2%D9%85%D8%A7%D9%86-%D8%AA%D9%86%D8%B8%DB%8C%D9%85-%D9%85%D9%82%D8%B1%D8%B1%D8%A7%D8%AA-%D9%88-%D8%A7%D8%B1%D8%AA%D8%A8%D8%A7%D8%B7%D8%A7%D8%AA-%D8%B4%D8%AF\"><span style=\"font-weight: 400\">10 November<\/span><\/a><span style=\"font-weight: 400\"> Sadegh Abbasi-Shahkuh was appointed as the new Head of the Communications Regulatory Authority (CRA) by the ICT Minister Eisa Zarepour. The airline <\/span><a href=\"https:\/\/www.isna.ir\/news\/1400083023320\/%D8%AA%D9%88%D8%B6%DB%8C%D8%AD-%D9%87%D9%88%D8%A7%D9%BE%DB%8C%D9%85%D8%A7%DB%8C%DB%8C-%D9%85%D8%A7%D9%87%D8%A7%D9%86-%D8%AF%D8%B1%D8%A8%D8%A7%D8%B1%D9%87-%D8%AD%D9%85%D9%84%D9%87-%D8%B3%D8%A7%DB%8C%D8%A8%D8%B1%DB%8C-%D8%A8%D9%87-%D8%A7%DB%8C%D9%86-%D8%B4%D8%B1%DA%A9%D8%AA\"><span style=\"font-weight: 400\">confirmed<\/span><\/a><span style=\"font-weight: 400\"> the attack and said that it had caused disruptions to its \u201coperational systems\u201d but \u201ccorrective action\u201d had been taken and that such attacks on the airline are \u201cnormal.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">A group known as Hooshyaran-e-Vatan <\/span><a href=\"https:\/\/twitter.com\/Hooshyaran1\/status\/1462288721764618243?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1462288721764618243%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.radiofarda.com%2Fa%2F31571694.html\"><span style=\"font-weight: 400\">claimed<\/span><\/a><span style=\"font-weight: 400\"> responsibility for the attack via a tweet, stating that this was the \u201cfirst step in stopping the theft from the people of Ahvaz and Khuzestan by the Iranian Revolutionary Guard Corps (IRGC).\u201d The group also said that they had acquired documents that would \u201dprove the airline's cooperation with IRGC\u2019s illegal actions.\u201d A Spokesperson for Mahan Air <\/span><a href=\"https:\/\/www.entekhab.ir\/fa\/news\/648579\/%D8%B3%D8%AE%D9%86%DA%AF%D9%88%DB%8C-%D9%87%D9%88%D8%A7%D9%BE%DB%8C%D9%85%D8%A7%DB%8C%DB%8C-%D9%85%D8%A7%D9%87%D8%A7%D9%86-%D8%A7%D8%B7%D9%84%D8%A7%D8%B9%D8%A7%D8%AA-%D9%87%DA%A9-%D8%B4%D8%AF%D9%87-%D9%81%D8%A7%D9%82%D8%AF-%D8%A7%D9%87%D9%85%DB%8C%D8%AA-%D8%A7%D8%B3%D8%AA\"><span style=\"font-weight: 400\">claimed<\/span><\/a><span style=\"font-weight: 400\"> that the hacked information is \u201cof no significance and flights are taking place as planned.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In 2011 Mahan Air was designated as a \u201cmaterial and transportation supporter of terrorism\u201d by the US Treasury \u201cfor providing financial, material and technological support to the IRGC\u2019s Qods Force\u201d.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Iran has been experiencing a surge in cyberattacks, including an <\/span><a href=\"https:\/\/filter.watch\/en\/2021\/11\/10\/policy-monitor-october-2021\/\"><span style=\"font-weight: 400\">attack<\/span><\/a><span style=\"font-weight: 400\"> on petrol stations\u2019 payment systems in October, an earlier attack on the country\u2019s Transport Ministry in <\/span><a href=\"https:\/\/filter.watch\/en\/2021\/08\/18\/policy-monitor-july-2021\/\"><span style=\"font-weight: 400\">July<\/span><\/a><span style=\"font-weight: 400\">, and the <\/span><a href=\"https:\/\/filter.watch\/en\/2021\/09\/15\/policy-monitor-august-2021\/\"><span style=\"font-weight: 400\">publication<\/span><\/a><span style=\"font-weight: 400\"> of footage from Iran\u2019s political prison Evin, in August, following an alleged hack. Different groups have claimed responsibility for these attacks, and it is unclear whether they are connected or coordinated.\u00a0<\/span><\/p>\n<h2><b>Divar\u2019s CEO Receives Prison Sentence for \u201cEnabling Corruption\u201d\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400\">On <\/span><a href=\"https:\/\/divar.ir\/daal\/divar-plus\/announcement-ceo-statement\/\"><span style=\"font-weight: 400\">27 November<\/span><\/a><span style=\"font-weight: 400\"> the Irainian e-commerce and advertising platform Divar released a statement confirming that the company\u2019s CEO Ashkan Mirarmandehi, had received a prison sentence for three months and one day following a decision from Tehran\u2019s Court of Appeal. The sentence relates to charges of \u201cenabling corruption and sex work.\u201d In its statement Divar has denied these charges, adding that the adverts in question did not contain any illegal content and the sentence received by Mirarmandehi is based on the actions of third parties outside of the platform.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The news of Mirarmandehi\u2019s sentence was met with widespread concern from Iran\u2019s tech and start-up community. Mirarmandehi received support from across the country\u2019s tech sector, including from <\/span><a href=\"https:\/\/twitter.com\/tehrannsr\/status\/1464891780491587586\"><span style=\"font-weight: 400\">Tehran\u2019s ICT Guild<\/span><\/a><span style=\"font-weight: 400\">, the <\/span><a href=\"https:\/\/twitter.com\/ARASHka\/status\/1464673301645729799\"><span style=\"font-weight: 400\">CEO of Shatel Mobile<\/span><\/a><span style=\"font-weight: 400\">,<\/span><a href=\"https:\/\/twitter.com\/anjidani\"><span style=\"font-weight: 400\"> the founder of Gap Messenger<\/span><\/a><span style=\"font-weight: 400\">, the e-payment platform <\/span><a href=\"https:\/\/twitter.com\/zarinpal\/status\/1464665355339673602\"><span style=\"font-weight: 400\">Zarinpal<\/span><\/a><span style=\"font-weight: 400\">, <\/span><a href=\"https:\/\/twitter.com\/MMonshipour\/status\/1464667985466077195\"><span style=\"font-weight: 400\">Tap30,<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/twitter.com\/HaMohammadi\/status\/1464683804996603909\"><span style=\"font-weight: 400\">Digikala<\/span><\/a><span style=\"font-weight: 400\"> among others.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Following this reaction, on 29 November a number of domestic news outlets reported that Iran\u2019s Head of Judiciary, Mohsen Eje\u2019i is stepping in to review the sentence. According to a <\/span><a href=\"https:\/\/twitter.com\/jamal_hadian\/status\/1465209653982343168?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1465209653982343168%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.dw.com%2Ffa-ir%2FD8AFD8B3D8AAD988D8B1-D8A8D8B1D8B1D8B3DB8C-D985D8ACD8AFD8AF-D9BED8B1D988D986D8AFD987-D985D8ADDAA9D988D985DB8CD8AA-D985D8AFDB8CD8B1-D8B3D8A7DB8CD8AA-D8AFDB8CD988D8A7D8B1%2Fa-59968048\"><span style=\"font-weight: 400\">tweet<\/span><\/a><span style=\"font-weight: 400\"> by the ICT Ministry\u2019s Spokesperson Jamal Hadiyan on the same day, the ICT Minister Eisa Zarepour had also asked for the sentence to be reviewed.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The issue of intermediary liability continues to be a major concern among Iran\u2019s private tech sector and start-up community, as platforms and service providers are continued to be held legally liable for user-generated content or behavior. Previously, the co-founder and Managing Director of Zarinpal <\/span><a href=\"https:\/\/filter.watch\/en\/2021\/01\/11\/policy-monitor-december-2020\/\"><span style=\"font-weight: 400\">received<\/span><\/a><span style=\"font-weight: 400\"> a one year prison sentence for a disputed payment via the e-payment platform, the Managing Director of video streaming platform <\/span><a href=\"https:\/\/filter.watch\/en\/2020\/11\/16\/policy-monitor-october-2020\/\"><span style=\"font-weight: 400\">received<\/span><\/a><span style=\"font-weight: 400\"> a 10 year sentence for a video shared on the platform, and the founder of Gap messenger was <\/span><a href=\"https:\/\/blog.gap.im\/fa\/posts\/view\/5d1c6f2091abbc001d202d52\/%25D8%25A8%25D8%25B1%25D8%25AE%25D9%2588%25D8%25B1%25D8%25AF-%25D8%25B9%25D8%25AC%25DB%258C%25D8%25A8-%25D8%25A8%25D8%25A7-%25DB%258C%25DA%25A9-%25DA%25A9%25D9%2584%25D8%25A7%25D9%2587%25D8%25A8%25D8%25B1%25D8%25AF%25D8%25A7%25D8%25B1%25DB%258C\"><span style=\"font-weight: 400\">summoned<\/span><\/a><span style=\"font-weight: 400\"> by the Police and the Judiciary in relation to stolen and fraudulent cards being used to purchase mobile phone credit.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Intermediary protections are vital for preserving freedom of expression, as well as encouraging technological innovation and expansion, an area where Iranian tech companies lack protection. This issue is unlikely to be resolved by the current iteration of the \u201cOnline Services Bill\u201d as it places numerous onerous obligations on platforms before they are offered protections as an intermediary. It remains to be seen if future drafts of the Bill will seek to address this issue.\u00a0<\/span><\/p>\n<p><img decoding=\"async\" class=\"alignnone wp-image-2304\" src=\"https:\/\/filter.watch\/en\/wp-content\/uploads\/sites\/2\/2020\/05\/economy-300x25.png\" alt=\"\" width=\"960\" height=\"80\" srcset=\"https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2020\/05\/economy-300x25.png 300w, https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2020\/05\/economy-1024x84.png 1024w, https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2020\/05\/economy-768x63.png 768w, https:\/\/filter.watch\/wp-content\/uploads\/sites\/2\/2020\/05\/economy.png 1500w\" sizes=\"(max-width: 960px) 100vw, 960px\" \/><\/p>\n<h2><b>Disputed User Numbers for Iran\u2019s Domestic Messaging Apps Provided by the National Centre for Cyberspace\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400\">During a session of the Joint Special Parliamentary Committee (the committee in charge of reviewing the \u201cOnline Services Bill\u201d) on <\/span><a href=\"https:\/\/www.ictna.ir\/id\/130534\/\"><span style=\"font-weight: 400\">19 November<\/span><\/a><span style=\"font-weight: 400\">, Amir Khorakian, Deputy for Legal and Parliamentary Affairs at the National Centre for Cyberspace, offered a <\/span><a href=\"https:\/\/www.asriran.com\/fa\/news\/813324\/%DA%86%D9%86%D8%AF-%D9%85%DB%8C%D9%84%DB%8C%D9%88%D9%86-%DA%A9%D8%A7%D8%B1%D8%A8%D8%B1-%D8%A7%D8%B2-%D9%BE%DB%8C%D8%A7%D9%85%E2%80%8C%D8%B1%D8%B3%D8%A7%D9%86%E2%80%8C%D9%87%D8%A7%DB%8C-%D8%AF%D8%A7%D8%AE%D9%84%DB%8C-%D8%A7%D8%B3%D8%AA%D9%81%D8%A7%D8%AF%D9%87-%D9%85%DB%8C%E2%80%8C%DA%A9%D9%86%D9%86%D8%AF\"><span style=\"font-weight: 400\">report<\/span><\/a><span style=\"font-weight: 400\"> on the performance of domestic messaging platforms.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">According to Khorakian\u2019s report to the Committee there are around \u201c20 million unique users\u201d across domestic applications such as Eita, Soroush Plus, Baleh, and Gap.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The accuracy of figures offered by Khorakian during the Committee session are difficult to verify, and therefore should be treated with caution, especially given the lack of transparency around their sourcing. Even some of Khorakian\u2019s parliamentary colleagues cast doubt on the veracity of the figures: during the same session, Afshin Kolahi, a member of the Commission for Innovative Businesses at Iran\u2019s Chamber of Commerce, Industries, Mines, and Agriculture (ICCIMA) called for the Majles to check the correct figures to base their decisions on, as he said some users were not on the named apps \u201cvoluntarily\u201d. The same issue was <\/span><a href=\"https:\/\/twitter.com\/Peivast\"><span style=\"font-weight: 400\">raised<\/span><\/a><span style=\"font-weight: 400\"> by Jalal Rashidi Kouchi MP during the session, who said that despite never signing up for the messaging app \u201cBale\u201d, he was informed of an account on the app in his name. However the statement that it currently had \u201cno immediate plans to leave Iran.\u201d However, the US sanctions imposed on Iran could <\/span><a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2021-06-01\/iran-s-push-to-lift-sanctions-boosts-mtn-s-plan-to-withdraw-cash\"><span style=\"font-weight: 400\">complicate<\/span><\/a><span style=\"font-weight: 400\"> any potential exit plans by MTN as they restrict the company\u2019s ability to move large amount of foreing currency out of Iran.\u00a0<\/span><\/p>\n<h2><b>Iran\u2019s Biggest eCommerce Platform \u2018Digikala\u2019 Crashes \u201cDue to High Demand\u201d<\/b><\/h2>\n<p><span style=\"font-weight: 400\">On <\/span><a href=\"https:\/\/peivast.com\/p\/117711\"><span style=\"font-weight: 400\">28 November<\/span><\/a><span style=\"font-weight: 400\">, Iran\u2019s largest e-commerce platform Digikala became unavailable for around 38 minutes ahead of the start of Black Friday sales. Ali Foroutannejad, Head of Engineering at Digikala said that \u201crecord breaking\u201d traffic was seen on the platform from sellers listing their sale items.
