{"id":2421,"date":"2020-08-14T16:12:12","date_gmt":"2020-08-14T16:12:12","guid":{"rendered":"https:\/\/filter.watch\/en\/?p=2421"},"modified":"2020-09-03T20:14:04","modified_gmt":"2020-09-03T20:14:04","slug":"irans-legal-vpns-and-the-threat-to-digital-rights","status":"publish","type":"post","link":"https:\/\/filter.watch\/english\/2020\/08\/14\/irans-legal-vpns-and-the-threat-to-digital-rights\/","title":{"rendered":"Iran\u2019s \u201cLegal VPNs\u201d and the Threat to Digital Rights"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">On <\/span><a href=\"https:\/\/itiran.com\/2020\/04\/13\/%D9%88%D8%A7%DA%AF%D8%B0%D8%A7%D8%B1%DB%8C-vpn-%D9%82%D8%A7%D9%86%D9%88%D9%86%DB%8C-%D9%88%DB%8C-%D9%BE%DB%8C-%D8%A7%D9%86\/\"><span style=\"font-weight: 400;\">13 April <\/span><\/a><span style=\"font-weight: 400;\">this year, the Secretary to the Supreme Council for Cyberspace (SCC) Abolhassan Firouzabadi announced that a regulatory guidance for \u201cLegal VPNs\u201d has been finalised by the Committee for Determining Instances of Criminal Content (CDICC). He also added that the ICT Ministry will be in charge of deciding who will have access to legal VPNs. Since the text of the said regulation has not yet been made publicly available, this has raised confusion and concern among many Iranians.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This confusion is only natural, given that VPNs are most known to Iranians as circumvention tools that can bypass government filtering; the paradox of authorities implementing a hyper-restrictive filtering regime on the one hand, and legalising a market for bypassing it on the other is perplexing for many people.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the snippets of news that have emerged have been received with concern by Internet users inside Iran. Given the recent history of censorship and surveillance (and the CDICC\u2019s role in implementing this) many have speculated that any new initiatives will seek to further restrict access to information, or to expand the state\u2019s surveillance capacities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This announcement \u2013 especially in absence of detail \u2013 may seem far-fetched, or unlikely to materialize. In this edition of Filterwatch, we will look at the historical context around the development of \u201cLegal VPNs\u201d, and in doing so will demonstrate that a form of \u201cLegal VPN\u201d distribution is already in place, and already undermining Iranians\u2019 digital rights. This recent announcement however presents a real threat by expanding on these current practices.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">We will also speculate what form these new \u201cLegal VPNs\u201d might take, and what these developments may mean for digital rights in the short- and long term.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">We argue that Iran\u2019s continuing work around \u201cLegal VPNs\u201d must be taken seriously as a core component of the state\u2019s overarching strategy to localise the internet, and impose \u201clayered filtering\u201d to grant different levels of access to different social groups. These recent developments demonstrate again that new forms of information controls implemented in Iran may be challenging to detect, and could disrupt existing circumvention strategies in the medium-to-long term.<\/span><\/p>\n<p><b>A Defeated Old Project?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The first trace of \u201cLegal VPNs\u201d, or state-sanctioned VPNs could be spotted in the final months of the Ahmadinejad administration. On <\/span><a href=\"https:\/\/www.dw.com\/fa-ir\/%D8%AF%D8%B3%D8%AA%D8%B1%D8%B3%DB%8C-%D8%AF%D9%88%D9%84%D8%AA-%D8%A8%D9%87-%D8%A7%D8%B7%D9%84%D8%A7%D8%B9%D8%A7%D8%AA-%DA%A9%D8%A7%D8%B1%D8%A8%D8%B1-%D8%A8%D8%A7-%D8%AB%D8%A8%D8%AA%D9%86%D8%A7%D9%85-%D9%88%DB%8C%D9%BE%DB%8C%D8%A7%D9%86-%D9%82%D8%A7%D9%86%D9%88%D9%86%DB%8C\/a-16609165\"><span style=\"font-weight: 400;\">17 February 2013<\/span><\/a><span style=\"font-weight: 400;\">, Iran\u2019s National Centre for Cyberspace (NCC) opened up registrations for receiving \u201cLegal VPNs\u201d. The online registration process was hosted at \u201cvpn.ir\u201d, and was open to organisations and individuals who held posts that \u201centitled\u201d them to access to the state-backed<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Registration was open for six days, and <\/span><a href=\"https:\/\/www.radiofarda.com\/a\/f10-iran-registeration-for-legal-vpn\/24910406.html\"><span style=\"font-weight: 400;\">closed on 23 February<\/span><\/a><span style=\"font-weight: 400;\">. After this, officials announced that soon a separate registration process would begin for individuals to receive state-backed VPNs. However such a promise never fully materialised and on <\/span><a href=\"https:\/\/www.mehrnews.com\/news\/2077623\/%D8%A7%D8%B1%D8%A7%D8%A6%D9%87-%D8%AE%D8%AF%D9%85%D8%A7%D8%AA-VPN-%D9%82%D8%A7%D9%86%D9%88%D9%86%DB%8C-%D8%A8%D9%87-70-%D8%B3%D8%A7%D8%B2%D9%85%D8%A7%D9%86-%D9%88-%D9%85%D9%88%D8%B3%D8%B3%D9%87-%D8%AB%D8%A8%D8%AA-%D9%86%D8%A7%D9%85-VPN-%D8%A7%D8%AF%D8%A7%D9%85%D9%87\"><span style=\"font-weight: 400;\">16 June 2013<\/span><\/a><span style=\"font-weight: 400;\"> Mehdi Khodayi, the Head of Public Relations at the Telecommunication Infrastructure Company (TIC) announced that 70 organisations have already received their legal VPNs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Only days later, on <\/span><a href=\"https:\/\/www.khabaronline.ir\/news\/304012\/%D8%B4%DA%A9%D8%B3%D8%AA-%D9%BE%D8%B1%D9%88%DA%98%D9%87-%D9%88%DB%8C-%D9%BE%DB%8C-%D8%A7%D9%86-%D9%82%D8%A7%D9%86%D9%88%D9%86%DB%8C-%D8%A7%D8%B2-%D8%B2%D8%A8%D8%A7%D9%86-%D9%85%D8%AF%DB%8C%D8%B1%D8%B9%D8%A7%D9%85%D9%84-%D8%B4%D8%B1%DA%A9%D8%AA-%D8%B2%DB%8C%D8%B1-%D8%B3%D8%A7%D8%AE%D8%AA\"><span style=\"font-weight: 400;\">22 June 2013 <\/span><\/a><span style=\"font-weight: 400;\">\u00a0the then Head of the TIC, Mahmoud Khosravi\u00a0 announced that despite spending \u201cmillions\u201dy, only 26 companies had registered \u2013 contradicting the earlier statistics. As a result, the TIC announced that the scheme was ending, and that \u201clegal VPNs for individuals\u201d would not be rolled out \u2013 the promise of opening registration to the general public never materialised. However, Iranian officials continued to insist that companies and organisations that needed to bypass internet filtering could apply for a licence, and receive permission to do so. However, since then, no attempt has been made to broaden access to these VPNs to the general public.\u00a0<\/span><\/p>\n<p><b>Current State of VPN Usage in Iran\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">According to <\/span><a href=\"https:\/\/www.asriran.com\/fa\/news\/635271\/%D9%BE%D9%84%DB%8C%D8%B3-%D9%81%D8%AA%D8%A7%D8%A7%D8%B3%D8%AA%D9%81%D8%A7%D8%AF%D9%87-10-%D8%AA%D8%A7-12-%D9%85%DB%8C%D9%84%DB%8C%D9%88%D9%86-%D9%86%D9%81%D8%B1-%D8%A7%D8%B2-%D9%81%DB%8C%D9%84%D8%AA%D8%B1-%D8%B4%DA%A9%D9%86-%D8%AF%D8%B1-%D8%A7%DB%8C%D8%B1%D8%A7%D9%86\"><span style=\"font-weight: 400;\">Iran\u2019s Cyber Police (FATA)<\/span><\/a><span style=\"font-weight: 400;\">\u2019s own figures\u00a0 in October 2018 there were 10 to 12 millions VPN users in Iran \u2013 likely to be one of the highest percentages globally. There are three factors that have given rise to the prevalence of VPNs over the past decade:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Firstly, the censorship of online content. Ten years of highly restrictive filtering practices \u2013 affecting a number of major social networking sites and communications apps, such as Twitter, Facebook and Telegram \u2013 has led to a huge surge in the usage of VPNs and other circumvention tools in Iran.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Secondly, the <\/span><a href=\"https:\/\/way2pay.ir\/17385\/\"><span style=\"font-weight: 400;\">vague legal status of VPNs<\/span><\/a><span style=\"font-weight: 400;\">. Currently, the widespread interpretation of existing law is that the use of VPNs is not unlawful \u2013 it is only their sale that is perceived to be punishable.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The third factor is the widespread availability of VPNs and circumvention tools. Since the 2009 post-election protests, the digital rights community have produced a wide range of VPNs and anti-censorship tools, which have been made available to Iranians for free. Millions of Iranians use these tools on a daily basis to access the internet. As well as these free tools, there is a huge market of commercial VPNs which are sold in Iran, many of which are hosted inside the country.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">While widespread usage of VPNs is to be welcomed especially for privacy and security reasons, despite the best efforts and warnings of digital rights activists, a huge number of Iranian users still use VPNs which are bought, sold and hosted within Iran. A number of questions about their safety and security have been raised over the years, with many warning that these VPNs could have connections to the Iranian authorities and security forces.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although the Iranian authorities have never confirmed their involvement in regulating the sale of VPNs in Iran, some recent comments in the Majles by ICT Minister Mohammad-Javad Azari Jahromi have partially confirmed suspicions that the current VPN market in Iran only exists with the tacit permission of some authorities.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.irna.ir\/news\/83462547\/%D8%A2%D8%B0%D8%B1%DB%8C-%D8%AC%D9%87%D8%B1%D9%85%DB%8C-%D9%85%D8%A7%D9%81%DB%8C%D8%A7%DB%8C-%D9%81%DB%8C%D9%84%D8%AA%D8%B1%D8%B4%DA%A9%D9%86-%D9%87%D8%A7-%DA%A9%DB%8C%D8%B3%D8%AA\"><span style=\"font-weight: 400;\">In September 2019,<\/span><\/a><span style=\"font-weight: 400;\"> When the Iranian Parliament questioned Azari Jahromi about the state of Iran\u2019s Internet, he spoke about the circumvention tools \u201cmafia\u201d in Iran, claiming that it is \u201cimpossible\u201d that authorities do not know who is behind the network of VPN sellers in Iran, and hinting at the lack of interventions from both FATA and the Judiciary.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Azari Jahromi is correct that the current VPN market in Iran leaves both buyers\u2019 and sellers\u2019 identities exposed to authorities. The <\/span><a href=\"https:\/\/internet.ir\/shekayat\/vpn_proxy\"><span style=\"font-weight: 400;\">CDICC even has a section<\/span><\/a><span style=\"font-weight: 400;\"> on its website asking people to record the financial information (such as bank transfer details) of VPN sellers inside the country.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although it is repeated time and time again that the sale of VPNs is illegal, these domestic vendors continue to freely sell their products using different parts of the Iranian online financial system, including prepaid cards. This practice exposes the identity of sellers and buyers to the authorities, as the information for the buyers and sellers are recorded, and financial intermediaries in Iran charge transaction fees to make the transactions possible.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Even in October 2019, Deputy ICT Minister and the Head of the TIC\u00a0 Hamid Fatahi<\/span><a href=\"https:\/\/www.yjc.ir\/fa\/news\/7117731\/%D9%84%DB%8C%D8%B3%D8%AA-%D8%AF%D8%B1%DA%AF%D8%A7%D9%87%D9%87%D8%A7%DB%8C-%D8%AA%D8%A8%D9%84%DB%8C%D8%BA%D8%A7%D8%AA-%D9%88-%D9%81%D8%B1%D9%88%D8%B4-vpn-%D8%B1%D8%A7-%DA%AF%D8%B2%D8%A7%D8%B1%D8%B4-%DA%A9%D8%B1%D8%AF%DB%8C%D9%85\"><span style=\"font-weight: 400;\"> stated<\/span><\/a><span style=\"font-weight: 400;\"> that the ICT Ministry had submitted a list of VPN vendors to the judiciary. He also claimed that other state organisations in Iran have submitted a list of 200-300 VPN sellers to the Iranian judiciary.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As well as these commercial domestic VPNs, there are other VPNs and circumvention tools which are openly sanctioned by the authorities and are currently in use in Iran. In recent years a number of service providers in Iran have offered circumvention tools to Iranians to help them bypass US-imposed sanctions, and to access sites closed to Iranians.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In <\/span><a href=\"https:\/\/digiato.com\/article\/2020\/08\/10\/%D8%AF%D8%B3%D8%AA%D8%B1%D8%B3%DB%8C-%D8%A8%D9%87-%D9%88%D8%A8%E2%80%8C%D8%B3%D8%A7%DB%8C%D8%AA%E2%80%8C%D9%87%D8%A7%DB%8C-%D8%AA%D8%AD%D8%B1%DB%8C%D9%85%E2%80%8C%DA%A9%D9%86%D9%86%D8%AF%D9%87-ip\/\"><span style=\"font-weight: 400;\">August<\/span><\/a><span style=\"font-weight: 400;\"> the ISP Shatel announced that it had added a new service for its customers allowing them access to a large number of sites which \u2013 according to Shatel \u2013 do not provide services to Iranian IP addresses. According to Shatel, these sites,<\/span><a href=\"https:\/\/twitter.com\/ARASHka\/status\/1290630026581479424\"><span style=\"font-weight: 400;\">such as Adobe, Intel, and Oracle<\/span><\/a><span style=\"font-weight: 400;\"> closed their services to Iranians, citing US-imposed sanctions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is not the first time that state-backed services have provided access to sanctioned\u00a0 websites. <\/span><a href=\"https:\/\/shecan.ir\/\"><span style=\"font-weight: 400;\">Shecan<\/span><\/a><span style=\"font-weight: 400;\"> has been operating in Iran for some time now, offering a circumvention tool for any Iranian Internet user to help them bypass sanctions. Both Shecan and Shatel are otherwise fully in line with Iran\u2019s filtering regime, denying access to sites filtered by the Iranian authorities. The availability of these tools tells us that there is no need for a new regulatory framework to offer VPNs to bypass sanctions.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The current approach to VPNs by the Iranian authorities is driven by two motives; firstly, financial gain, and secondly, the facilitation of surveillance and censorship practices. Exploring how Iran is currently benefiting from the VPN market and other domestic VPNs gives us an insight into why Iran may be seeking to further expand and formalise the sale of \u201clegal VPNs\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As the current market makes use of Iran\u2019s online banking system, Iranian authorities benefit from every transaction. But perhaps more substantially, they benefit financially from Iran\u2019s lack of net neutrality, which means that internet browsing via VPNs costs users significantly more than non-VPN-based activity.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Surveillance remains the most concerning motive, however. Whereas a secure VPN significantly improves the security of Iranian internet users, an unsafe VPN service can significantly increase the risk of surveillance by those who have access to the VPN\u2019s backend. Given that Iranian officials have stated on a number of occasions that they have drawn up a list of VPN vendors inside Iran (and given that they appear to operate without any legal consequences), it is entirely possible that the state security services may have approached the VPN vendors seeking cooperation, and access to their users\u2019 data. Even if such an arrangement has not taken place, Iranian authorities may benefit from users\u2019 fears about domestic VPNs\u2019 dangers, inspiring user self-censorship.<\/span><\/p>\n<p><b>Layered Filtering and \u201cLegal VPNs\u201d<\/b><\/p>\n<p><span style=\"font-weight: 400;\">As noted, there are currently no public documents available describing the current proposed scheme for regulating \u201cLegal VPNs\u201d. However in an interview on <\/span><a href=\"https:\/\/www.irna.ir\/news\/83749464\/VPN-%D9%82%D8%A7%D9%86%D9%88%D9%86%DB%8C-%DA%86%D8%B7%D9%88%D8%B1-%D9%88-%D8%A7%D8%B2-%D8%B3%D9%88%DB%8C-%DA%A9%D8%AF%D8%A7%D9%85-%D9%86%D9%87%D8%A7%D8%AF-%D8%A8%D9%87-%D8%A7%D8%B4%D8%AE%D8%A7%D8%B5-%D9%88%D8%A7%DA%AF%D8%B0%D8%A7%D8%B1-%D9%85%DB%8C-%D8%B4%D9%88%D8%AF\"><span style=\"font-weight: 400;\">14 April<\/span><\/a><span style=\"font-weight: 400;\"> this year, former Deputy for Cyberspace Affairs at the Public Prosecutor's Office Javad Javidnia stated that the scheme\u2019s goal is to provide different groups of society \u2013 such as students or journalists \u2013 with differing levels of access to currently-filtered websites. Firouzabadi\u2019s comments from <\/span><a href=\"https:\/\/www.bbc.com\/persian\/iran-50373131\"><span style=\"font-weight: 400;\">11 November 2019<\/span><\/a><span style=\"font-weight: 400;\"> also confirms Javidnia\u2019s recent comment: in November last year Firouzabadi said that the CDICC had been asked to set different levels of access privilege for Iranian users, and promised that Iranian operators would soon create legal domestic VPNs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Iranian authorities are aware of the financial benefits and surveillance opportunities that regulating VPN vendors might bring. However, it can be argued that they are already enjoying a number of those benefits. In the absence of details, we can only speculate about the direction of the new scheme, the motives behind it, and the dangers it might pose to digital rights. We believe that the policies which are currently being developed by CDICC must be viewed as part of a wider plan for the implementation of \u201clayered filtering\u201d, a scheme supported and promoted by ICT Minister Azari Jahromi and the SCC. In the past we <\/span><a href=\"https:\/\/filter.watch\/en\/2019\/09\/19\/is-layered-filtering-the-future-of-irans-national-information-network\/\"><span style=\"font-weight: 400;\">have written<\/span><\/a><span style=\"font-weight: 400;\"> about the Layered filtering in Iran which seeks to grant different social groups in Iran different sets of privileges to bypass censorship regime.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Many Iranian policy makers have been arguing for the <\/span><a href=\"https:\/\/filter.watch\/2020\/06\/23\/%D8%A2%DB%8C%D8%A7-%D9%85%D8%AC%D9%84%D8%B3-%D9%85%DB%8C%E2%80%8C%D8%AA%D9%88%D8%A7%D9%86%D8%AF-%D8%A7%DB%8C%D9%86%D8%B3%D8%AA%D8%A7%DA%AF%D8%B1%D8%A7%D9%85-%D8%B1%D8%A7-%D9%81%DB%8C%D9%84%D8%AA%D8%B1\/\"><span style=\"font-weight: 400;\">filtering of Instagram<\/span><\/a><span style=\"font-weight: 400;\"> in Iran in recent months. It\u2019s opponents have argued that the filtering of Telegram may lead to further growth of\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">VPN use in Iran. It is likely that some policy makers at the ICT Ministry, CDICC and SCC view layered filtering and the \u201cLegal VPN\u201d scheme as solutions to this problem.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The new \u201cLegal VPN\u201d framework will likely enable Iranian authorities to expand on existing schemes (such as VPNs for selected journalists), and to grant certain (selected) groups unfiltered (but highly monitored) access to the internet.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It remains unclear how long it will take Iranian authorities to introduce the \u201cLegal VPN\u201d scheme, if it is to materialise. The scheme must be opposed by digital rights activists and internet users inside Iran. In addition, Iranian authorities must cease their battle against VPNs provided by digital rights activists outside the country. This is particularly important given <\/span><a href=\"https:\/\/filter.watch\/en\/2020\/06\/19\/data-insecurity-on-irans-localised-internet\/\"><span style=\"font-weight: 400;\">recent developments related to data security<\/span><\/a><span style=\"font-weight: 400;\"> which have highlighted the fundamental insecurity of the internet and user data inside Iran.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 13 April this year, the Secretary to the Supreme Council for Cyberspace (SCC) Abolhassan Firouzabadi announced that a regulatory guidance for \u201cLegal VPNs\u201d has been finalised by the Committee for Determining Instances of Criminal Content (CDICC).
